This website “www.sunbba.com” (the “Website”) is owned by NUBBA SPACES, S.L., commercially known as “Sunbba” (“Sunbba” or “we”), a company duly incorporated under Spanish law, with registered office at C/Llauder, 7 1º 3ª (08003 BARCELONA), VAT ID B-67834101, and registered with the Mercantile Registry of Tarragona under Volume 3086, Folio 88, Sheet T-53119, Entry 1.

PURPOSE

The purpose of this Website is the online sale of Sunbba products to end consumers for domestic use. If you are a professional or company, please contact us at hello@sunbba.com.

ACCEPTANCE AND ENTIRE AGREEMENT

Access to and use of our Website, including all its information, services, and content, is subject to applicable regulations and the provisions stated in these terms and policies.
Users of this Website (“User(s)”) acknowledge and agree that they have read and understood the Terms of Use and Sale, as well as the Privacy and Cookies Policies. By using our Website, the User expressly accepts and agrees to comply with them where applicable.
The illegality, invalidity or unenforceability of any part of these terms and policies will not affect the validity of the remaining provisions. Any such provision shall be replaced or supplemented by another lawful clause that best serves its original purpose. The parties waive any claim for damages arising from this circumstance.

MODIFICATIONS

Sunbba reserves the right to modify the Website’s terms and policies. Therefore, Users are encouraged to review them regularly. These modifications will not apply retroactively to already completed transactions, only to future ones.
If the Website terms and policies are modified, Sunbba will make every effort to inform Users so they can comply with or choose to stop using the Website and cancel their registered account. Continued use of the Website after changes are made constitutes acceptance of the new terms.
In the event of a conflict between current and previous versions of these terms, the current version shall prevail unless otherwise stated.

REGISTRATION AND ACCESS

Registration is not required to visit the Website. However, Users must register to place an order. Only adults residing in Spain, excluding the Canary Islands, Ceuta, and Melilla, may register. To complete registration, Users must provide accurate and truthful information, maintain confidentiality of their unique and non-transferable user account, and keep their data up to date.

USE OF THE WEBSITE

The User agrees to comply with these Terms.
Users are fully responsible for accessing and correctly using the Website and its content in accordance with the law, good faith, good customs, and public order.
Users must not use the Website’s content for illegal purposes or in ways that may damage, disable, or impair the Website or its content/services. Sunbba reserves the right to remove from its records any User who misuses the Website or breaches these terms, without prior notice.
Users must inform Sunbba immediately if their account is used by a third party without authorization.

DISCLAIMER OF LIABILITY

Sunbba may temporarily suspend Website services for technical, security, or maintenance reasons without entitling Users to compensation.
We may change or discontinue services without notice and are not responsible for the resulting unavailability.
If our Website contains links to other websites, Sunbba exercises no control over their content and assumes no responsibility for them. These links do not imply any affiliation or partnership.

INTELLECTUAL AND INDUSTRIAL PROPERTY

Sunbba, either as owner or licensee, holds all intellectual and industrial property rights over this Website and its contents (e.g. images, audio, video, software, texts, logos, color schemes, design...).
Reproduction, distribution, and public communication of the content, including via availability in whole or in part, in any medium or by any technical means, without Sunbba’s authorization, is expressly prohibited.
Users must respect Sunbba’s intellectual property and refrain from deleting or tampering with any security or protection systems on the Website.

APPLICABLE LAW AND JURISDICTION

The relationship between Sunbba and the User shall be governed by current Spanish law. Any dispute will be submitted to the Courts and Tribunals of Barcelona (Spain).
Users may also access the European Commission’s online dispute resolution platform for cross-border online transactions at: http://ec.europa.eu/consumers/odr/.

PRODUCTS AND PHOTOGRAPHS

Products are for domestic use only. Sunbba accepts no liability for use outside their intended purpose.
Images and descriptions are provided for illustrative purposes and do not guarantee exact likeness to the actual product.

PURCHASE PROCESS

After selecting products, Users will see a “Shopping Cart” with purchase details. To complete the order, Users must register or log in (or continue as a guest).
They will then choose a payment method. For any issues during purchase, Users should contact Sunbba using the available channels.

ORDERS

Order confirmation by the User constitutes a contractual purchase offer. It becomes binding once Sunbba confirms it via email and provides a receipt.
Sunbba may reject orders, notifying the User within 3 business days. If no replacement order is made, any amount paid will be refunded.

PRODUCT PRICING

Prices are listed in euros and include applicable taxes.
If a pricing error is identified, Sunbba will notify the User for confirmation or cancellation of the order.
All applicable fees, such as shipping, will be displayed during the checkout process.

PAYMENTS

Users confirm they are authorized to use their selected payment method and release Sunbba from liability for unauthorized use.
Declined payments will result in automatic order cancellation.
Delivery may be canceled in case of payment issues. A free second delivery will be scheduled; additional attempts may incur extra costs.
By purchasing, Users accept the terms of the selected payment provider, including:

• Credit Card (via Shopify): Handled by bank POS.
  
  

• PayPal: PayPal’s terms and privacy policy.
  
  

• AmazonPay / Apple Pay / Sequra: Each subject to their own terms and policies.
  
  

Bank Transfer Payments

Orders made by bank transfer will be held until confirmation. If payment is not received in time, the order will be cancelled.
Users must ensure correct details when making a transfer, including references or concepts provided by Sunbba. In case of error, the order will be cancelled.

DISCOUNTS AND VOUCHERS

Discounts must be used within their validity period and conditions.
They cannot be refunded, accumulated, or transferred.
Vouchers must be used in one purchase; unused balances will be forfeited. If the order exceeds the voucher amount, Users must pay the difference.

Right of Order Cancellation or Refusal by the Company

Sunbba reserves the right to cancel or refuse any order in the following circumstances:

• When misuse or fraudulent use of promotional codes, coupons, or discounts has been detected.

• When an order has been placed using a promotional code intended for a different market or delivery territory.

• When there are obvious errors in the price, offer conditions, or product availability.

• When there are other justified reasons that prevent proper processing or delivery of the order (e.g. logistical issues or suspected fraud).

In such cases, Sunbba will notify the customer and fully refund any amount paid, using the same payment method used at the time of purchase.

This policy does not affect the consumer’s legal right of withdrawal, applicable only to non-customised products in accordance with current regulations.

PRODUCT AVAILABILITY

Product availability is subject to stock. There may be slight delays in stock updates on the Website. Sunbba will notify Users of any discrepancies.

SHIPPING POLICY

Destinations and Timelines

Shipments are limited to EU countries. Timelines are business days (Mon-Fri) and vary by product, quantity, and destination (typically 1-7 days).
Sunbba may adjust timelines without prior notice and does not deliver to P.O. boxes. Estimated delivery times are indicated during checkout.
Delays outside Sunbba’s control may occur.

Shipments to the Canary Islands, Corsica and other regions with additional shipping costs

For orders destined for the Canary Islands, Corsica or other regions involving extra transport costs, the following specific conditions apply:

Application of surcharges

• The customer acknowledges and accepts that shipments to such regions will be subject to an additional shipping surcharge, the amount of which will be calculated and communicated at the time of purchase.

• This surcharge is separate from the standard shipping cost and will be charged in full to the customer.

Local taxes and charges

• Any costs arising from customs duties, local taxes, customs clearance services or temporary storage at the logistics centre of destination shall be borne exclusively by the customer.

• The company accepts no liability for delays or additional costs caused by customs or administrative formalities beyond its control.

Customer compliance

• The formalisation of the purchase for these regions implies the express acceptance of these shipping conditions.

• In case of doubt, the customer may contact customer service in advance to obtain a detailed estimate of possible additional costs.

Delays and Cancellations

Orders may be canceled if not delivered within 30 calendar days due to Sunbba’s fault.
Absence at delivery address is not valid cause for cancellation. Users must follow delivery instructions from Sunbba or the courier.
Sunbba is not liable for damage due to delivery delays caused by User absence.
Orders stored due to non-delivery (e.g. absence, payment failure, etc.) will be held for up to 3 months before cancellation and forfeiture of any payments made.
Repeated deliveries may incur storage or delivery fees.

Delivery Limitations

Users must inform Sunbba of any architectural or structural barriers that may hinder delivery.

RETURN POLICY (WITHDRAWAL)

Period

Where applicable, Users may cancel purchases within 14 calendar days of receiving the product.

Process

Users must notify Sunbba’s Customer Service before the withdrawal period expires and provide required documentation (e.g. product photos, invoice, etc.).
Optionally, they may use the withdrawal form provided by the OCU (link).

Financed Purchases

Users are solely responsible for financing agreements made with third-party institutions. Sunbba is not involved in or liable for such agreements.

Returns from Canary Islands, Corsica and other regions with additional transport costs

For orders shipped to the Canary Islands, Corsica or other regions involving additional transport costs, the following specific conditions apply:

 

Additional transport costs

• The customer acknowledges and accepts that the extra transport costs associated with the initial shipment will not be reimbursed.

• Likewise, the costs arising from the return of the product shall be borne exclusively by the customer.

• By way of example, if the initial shipment would have generated an additional cost of €100, this amount will also be applied as a return, so that the final refund will be reduced by a total of €200.

Costs associated with the return process

• The customer acknowledges and accepts that customs duties, local taxes, customs handling charges and any other costs associated with temporary storage in logistics centres in the region of destination are non-refundable.

Conformidad del cliente

• By making a purchase from these regions, you expressly accept these terms and conditions.

• In case of doubt prior to the formalisation of the purchase, the customer may contact the company's customer service department to obtain additional information..

PRODUCT WARRANTY

Legal warranty

Sunbba guarantees to consumer Users that the products marketed through the Website comply with the conformity requirements established under applicable law.

The legal warranty period is three (3) years from the date of delivery of the product, and shall apply in all countries to which Sunbba ships, including, among others, the European Union, the United Kingdom, Switzerland and Norway.

Scope of the warranty

The warranty exclusively covers manufacturing, material or assembly defects that result in a lack of conformity of the product with the contract.

By way of illustration and without limitation, the warranty includes:

Structure (L-shapes)

• Deformations, breakages or structural failures not attributable to improper use
  
  

• Defects in joints, welds or factory assemblies
  
  

• Corrosion or abnormal deterioration of materials
  
  

Backrest cushions and mini cushions

• Manufacturing defects in stitching or seams
  
  

• Faulty zippers from first use
  
  

• Premature deformation of filling not attributable to normal use
  
  

• Significant colour differences compared to those displayed at the time of purchase
  
  

Covers (mattresses and upholstery)

• Manufacturing defects in stitching or finishing
  
  

• Faulty zippers or fastening systems from first use
  
  

Any component

• Items delivered with damage or defects attributable to the manufacturing process or to transport managed by Sunbba, provided such damage is documented upon delivery
  
  

Warranty exclusions

The warranty expressly excludes any damage or incident not arising from a manufacturing defect, including, by way of illustration and without limitation:

Normal wear and tear

• Fabric pilling resulting from continuous use
  
  

• Progressive fading due to exposure to sunlight or other light sources
  
  

• Gradual loss of firmness of cushions due to regular use
  
  

Improper use or negligence

• Stains, burns, cuts or tears attributable to the User
  
  

• Damage caused by the use of cleaning products not recommended by Sunbba
  
  

• Use of the product under unsuitable conditions
  

• Breakages resulting from misuse or structural overloading
  
  

External causes

• Damage caused by third parties or domestic accidents
  
  

• Damage arising from transport not managed by Sunbba
  
  

• Damage caused by force majeure events, including, without limitation, fires, floods or natural disasters.
  
  

Claims procedure

The User must notify Sunbba of any lack of conformity as soon as reasonably possible after becoming aware of it, through the available contact channels.

The claim must include:

• Proof of purchase (invoice, receipt or order confirmation)
  
  

• Sufficient visual evidence (at least two (2) photographs) enabling verification of the defect
  
  

Once the claim has been assessed, Sunbba shall, in accordance with applicable law, proceed with repair, replacement, price reduction or contract termination, as appropriate.

Presumption of conformity

A product shall be deemed to be in conformity with the contract, and therefore not covered by the warranty, when:

a) It matches the description, type and qualities presented by Sunbba on the Website
b) It is fit for the ordinary purposes for which products of the same type are normally used
c) It is fit for any specific purpose requested by the User and expressly accepted by Sunbba at the time of purchase.
